Allgemeine Geschäftsbedingungen
Stand: Oktober 2026
§ 1 Geltungsbereich
Diese Bedingungen gelten für die Nutzung von Maxecaster, einem Angebot von maxecute, Inhaber Mustafa Morad, Thomasstr. 4, 58089 Hagen („Anbieter“), durch Verbraucherinnen und Verbraucher sowie Unternehmen („Kunde“).
§ 2 Leistungen
Terms and conditions

§ 1 Scope
These terms apply to the use of Maxecaster, a service of maxecute, owner Mustafa Morad, Thomasstr. 4, 58089 Hagen (“Provider”), by consumers and businesses (“Customer”).
§ 2 Services
Maxecaster provides browser-based software for recording, editing, broadcasting in the Customer’s own webinar room and publishing audio and video content. Forwarding broadcasts to third-party platforms (e.g. YouTube, Twitch) is not part of the service. The scope of services depends on the plan selected on the pricing page. The Provider aims for an availability of 99% on an annual average; announced maintenance and disruptions beyond the Provider’s control are excluded.
§ 3 Conclusion and term of contract
The contract is concluded upon registration (free plan) or upon completion of the order for a paid plan. Paid plans run for one month and renew for one further month each time unless cancelled by the end of the current term. Cancellation is possible at any time in the dashboard or by email.
§ 4 Prices and payment
The prices valid at the time of the order apply. All prices include 19% VAT. Payment is made monthly in advance.
§ 5 Customer obligations
The Customer obtains the necessary consent of all persons recorded (Maxecaster supports this through the consent step in the waiting room), respects copyright, personality rights and data protection rights, and does not publish unlawful content. Login credentials and invitation links must be kept confidential.
§ 6 Data and data processing
Insofar as the Customer processes personal data of third parties, the Provider acts as a processor. The data processing agreement applies and becomes part of the contract upon acceptance of these terms. Maxecaster is not an archive: the video and audio files of a recording (individual tracks, overall mix, studio sound, editing package) are deleted automatically 3 days after processing has finished. Depending on the plan, the Customer can extend this period for individual recordings (Pro up to 14 days, Business up to 30 days, Enterprise by agreement). The Customer undertakes to download the media files within this period and confirms this before the first recording. The Provider sends a reminder by email as soon as a recording is ready and one day before the period expires. Confirmation, reminders, extensions and deletions are logged. Transcripts, subtitles, show notes, chapters and markers are deleted after the retention period configured in the workspace expires. There is no claim to the restoration of deleted media files; the Customer is responsible for their own backup copies.
§ 7 Liability
The Provider is liable without limitation for intent and gross negligence and for injury to life, body and health. In cases of slight negligence, the Provider is liable only for breaches of material contractual obligations, limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
§ 8 Right of withdrawal for consumers
Consumers have a fourteen-day right of withdrawal. The withdrawal period is fourteen days from conclusion of the contract. To exercise the right of withdrawal, a clear statement sent to info@maxecute.de is sufficient. If the Customer requests that the service begin before the end of the withdrawal period, a proportionate amount is payable for the services provided up to the time of withdrawal.
§ 9 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence. The place of jurisdiction for merchants is Hagen.
